Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "Couple", or "Host"), and CloudInvites ("we," "us", or "our"), concerning your access to and use of the cloudinvites.wedding website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
By registering for, accessing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.
You must be at least 18 years old and legally capable of entering into a binding contract to create an account. Our Privacy Policy and Cookie Policy are incorporated into these Terms by reference.
1. Account Responsibilities & Guest Data
As a Couple utilizing our platform to manage your wedding, you are fully responsible for all activities that occur under your account and any other actions taken in connection with it.
Crucially, you warrant that you have obtained the necessary consent from your guests to input their names, contact details, dietary restrictions, and any other personal information into our platform (specifically for the Entourage & Seating features). Furthermore, if you use our collaboration features (e.g., CloudCollab) to share this guest data with third-party suppliers or coordinators, you are solely responsible for ensuring you have the legal right and guest consent to distribute this information. CloudInvites is not liable for any disputes arising from the unauthorized uploading or sharing of third-party personal data by the account holder.
Delegated Access (Coordinators): If you grant access to a wedding coordinator or third-party manager to administer your wedding on the Site, you remain ultimately responsible for all actions taken under your account. You acknowledge that CloudInvites is not liable for any data loss, mismanagement, unauthorized sharing, or disputes arising from the actions of your authorized coordinators.
2. Purchases, Payment & Refunds
- One-time payments, no auto-renewal: CloudInvites is sold as a one-time purchase granting access for a fixed term — not a recurring subscription. We will never automatically charge you again, and there is nothing to cancel to avoid a future charge.
- Plan term: The Free Trial runs for 15 days; Essential is valid for 12 months and Premium for 18 months from activation. The CloudAlbum Suite add-on is governed by Section 3 below.
- Tiers & Pricing: We offer various plans (Free Trial, Essential at ₱2,499, and Premium at ₱5,999), plus optional one-time add-ons such as the CloudAlbum Suite at ₱1,999. Pricing and features are subject to change.
- Payments: All payments are processed securely via our partner, PayMongo. By submitting your payment details, you authorize us to charge the applicable fees to your selected payment method.
- 7-Day Money Back Guarantee: If a paid plan or add-on isn't right for you, you may request a full refund within 7 days of the date of purchase, provided the purchase is largely unused — specifically, that your website has not been published, you have added no more than 10 guests, no guest has submitted an RSVP, and no photos have been uploaded to your guest album. You can request this yourself from your account page. Refunds are returned via PayMongo to the original payment method and may take several banking days to appear.
- After the Guarantee Period: Because creating your customized subdomain provisions digital infrastructure immediately, we operate a strict no-refund policy once 7 days have passed from the date of purchase, or once the usage conditions above are exceeded. Upgrades are charged as the price difference between tiers, and that difference is itself covered by the guarantee from the date of the upgrade.
- Expiry of a plan: When a paid term or Free Trial expires, your website is taken offline and CloudInvites reserves the right to deactivate, archive, or release your subdomain and associated data in accordance with the retention schedule in our Privacy Policy.
- Gift codes & sponsored plans: Gift certificates and sponsorship links have no cash value, are not redeemable for cash, and are non-transferable once redeemed against a wedding.
3. CloudAlbums & Photo Deletion
The CloudAlbum guest photo album has its own lifecycle, independent of your website plan. Guests can upload during a window around your wedding day, after which the album becomes view-only.
Your album and every photo in it are permanently deleted 6 months after your wedding date. This deletion is irreversible. We will email you approximately 30 days beforehand with a link to download the complete album as a single archive, and you can prepare that download at any time from your CloudAlbum page. It is your responsibility to download and keep your own copy before the deletion date. CloudInvites is not liable for photographs lost after this period, and we cannot recover them once purged.
4. AI-Generated Content Disclaimer
CloudInvites incorporates advanced artificial intelligence (via Google Gemini) to assist with wedding planning tasks, including generating draft budgets, checklists, and story narratives. These AI outputs are provided for suggestion and inspirational purposes only.
We make no warranties regarding the accuracy, completeness, or financial soundness of these AI-generated templates. CloudInvites shall not be held legally or financially liable for any mismanagement, budget overruns, or planning failures resulting from reliance on these AI-generated suggestions.
5. Intellectual Property
- Our Property: The platform, its original content, features, functionality, and the Theme designs are and will remain the exclusive property of CloudInvites and its licensors.
- Your Property: You retain complete ownership of all personal photos, textual stories, and data you upload to the platform. By uploading content, you grant us a limited, non-exclusive license to host, display, and process it solely for the purpose of providing the service to you. This licence ends when your content is deleted, subject to the retention and deletion schedules described in Section 3 and our Privacy Policy. We do not use your photographs or wedding content for marketing or promotion without asking you first.
6. Acceptable Use
You agree not to use the Site to:
- Upload or share content that is unlawful, defamatory, obscene, hateful, or that infringes someone else's intellectual property or privacy rights.
- Upload personal data about third parties without the right to do so.
- Send unsolicited bulk messages, or use guest contact details for any purpose other than your wedding.
- Attempt to access another couple's wedding, account, or data; probe, scan, or test the security of the Site; or circumvent any access control, rate limit, or paywall.
- Upload malware, scrape the Site by automated means, or resell or sublicense access to the platform.
7. Service Availability & Limitations
We aim to provide continuous, high-quality service. However, the Site and services are provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for 100% uptime, we cannot guarantee that the Site will be available at all times without interruption.
CloudInvites shall not be liable for any damages, losses, or distress caused by service interruptions, failures of our hosting, storage, email, or payment providers, or downtime, especially if such interruptions occur on or near the date of your event.
To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the Site is limited to the amount you actually paid us in the twelve (12) months preceding the claim, and we are not liable for indirect, incidental, or consequential losses. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including your rights under the Philippine Consumer Act (RA 7394) and the Data Privacy Act (RA 10173).
8. Suspension & Termination
You may stop using the Site at any time and request that we close your account. We may suspend or terminate your access if you materially breach these Terms — in particular the Acceptable Use rules in Section 6 — or where required by law. Where it is practical and appropriate to do so, we will give you notice and an opportunity to put things right first. If we terminate your account for a breach you caused, the refund terms in Section 2 continue to apply on their own terms and are not extended by the termination.
9. Changes to These Terms
We may revise these Terms as the service develops. The "Effective Date" above always reflects the current version. If a change is material, we will take reasonable steps to notify account holders before it takes effect. Changes are not retroactive: a purchase you have already made continues to be governed by the plan term and refund conditions that applied when you bought it.
10. Governing Law & Disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the competent courts of the Philippines. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
